South Carolina Lyft Laws
South Carolina Law Title 58 – Public Utilities, Services and Carriers, Chapter 23, Motor Vehicle Carriers, Article 16, Transportation Network Company Act is the law that applies to Lyft transportation services in the state. A transportation network company (TNC) is a company that uses a digital network to connect a passenger to a driver. Lyft is a TNC.
Laws that apply to Lyft services in South Carolina include:
- TNC drivers must have insurance that acknowledges they are a ride share driver.
- A TNC driver must have insurance that specifically applies while they are logged into the network and while they are giving rides.
- While logged into the network, a driver must have at least $50,000 in bodily injury coverage per person, $100,000 total injury liability per accident and $50,000 for property damage; they must also have uninsured motorist insurance as required by S.C. Code § 38-77-150.
- During a ride, a driver must have at least one million dollars in liability coverage for death, bodily injury and property damage as well as uninsured motorist insurance as required by S.C. Code § 38-77-150.
- The TNC network company may provide the required insurance for the driver.
- Insurance provided by the TNC may not be contingent on a personal insurer denying a claim.
- Drivers must carry proof of insurance. If there’s an accident, they must give the insurance information to anyone involved and the police, if asked.
- Vehicles must have a certified mechanic inspection within 30 days of being used for driving for a TNC. A vehicle used for ridesharing must be inspected at least once a year.
In addition to rules that apply specifically to rideshare companies like Lyft, drivers must follow the rules of the road.
